Awarded without open competition
Awarded without open competition. The buyer went directly to one or a few suppliers instead of advertising the contract. Procurement rules allow this only in specific cases, such as extreme urgency, when only one supplier can do the work, or for call-offs from an existing framework.

Description
The contract is awarded by direct award under section 14 of the Procurement Reform (Scotland) Act 2014. The maintenance service relates to Zehnder air filters containing the patented ‘Flimmer’ filter, which is exclusively manufactured and supplied by Zehnder. The patented nature of the filter means that no third‑party supplier can lawfully or technically provide the required maintenance service. As competition is genuinely absent for technical and exclusive rights reasons, and no reasonable alternative exists, a competitive procurement exercise would not deliver competition.
